Terms of Service

1. Agreement to Terms

By downloading, installing, or using ShiftSlumber (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. These Terms form a binding legal agreement between you and ShiftSlumber ("ShiftSlumber", "we", "our", or "us"), a company registered in Queensland, Australia.

2. Description of Service

ShiftSlumber is a sleep-tracking application designed specifically for shift workers. The App enables you to:

ShiftSlumber is a wellness tool. It is not a medical device and does not provide medical advice, diagnosis, or treatment. See Section 8 (No Medical Advice) below.

3. Eligibility and Account Registration

You must be at least 18 years of age to use ShiftSlumber. By using the App, you represent and warrant that you meet this requirement.

Account registration (email) is optional. If you register, you agree to provide accurate information and to keep your account credentials secure. You are responsible for all activity that occurs under your account.

5. Subscription Terms

5.1 Free and Premium Tiers

ShiftSlumber is available on a free tier with limited features and a premium subscription that unlocks full functionality. Specific features available on each tier are described within the App and are subject to change.

5.2 How Subscriptions Work

Premium subscriptions are offered through the Apple App Store (iOS) or Google Play Store (Android). All subscription transactions are processed by Apple or Google respectively, through RevenueCat as our subscription management platform. By subscribing, you also agree to the terms of the relevant app store and RevenueCat.

You can cancel your subscription at any time through your Apple ID (Settings → [Your Name] → Subscriptions) or Google Play account (Play Store → Subscriptions). Cancellation takes effect at the end of the current billing period. No refunds are issued for partial billing periods, except where required by applicable law.

5.5 Refunds

All refund requests must be made through the Apple App Store or Google Play Store in accordance with their respective refund policies. ShiftSlumber does not process refunds directly.

5.6 B2B Organisation Plans

Organisation-level subscriptions for employers are billed via Stripe directly and are governed by a separate Organisation Agreement. Contact sleepportfolio@gmail.com for B2B licensing terms.

6. Intellectual Property

ShiftSlumber and all content, features, and functionality (including but not limited to text, graphics, logos, icons, images, audio clips, and software) are owned by ShiftSlumber and are protected by Australian and international copyright, trademark, and other intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable licence to use the App for your personal, non-commercial purposes in accordance with these Terms.

You retain ownership of any sleep data you enter into the App. You grant ShiftSlumber no rights to your personal sleep data — consistent with our zero-knowledge architecture in which that data stays encrypted on your device.

7. User Data and Privacy

Your privacy is important to us. Our collection, use, and protection of your personal information is described in our Privacy Policy, which forms part of these Terms. By using the App, you consent to our Privacy Policy.

8. No Medical Advice

Important: ShiftSlumber is a wellness and productivity tool for shift workers. It is NOT a medical device and does NOT provide medical advice, diagnosis, or treatment. Information provided by the App, including AI Coach guidance, sleep scores, shift impact scores, and GP-ready reports, is for informational purposes only and should not be relied upon as medical advice.

Always consult a qualified healthcare professional before making changes to your sleep habits, before using any sleep information as the basis for health decisions, or if you have concerns about a sleep disorder or other medical condition. ShiftSlumber does not establish a doctor-patient relationship.

9. Disclaimer of Warranties

The App is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

To the maximum extent permitted by applicable law (including the Australian Consumer Law), ShiftSlumber and its officers, directors, employees, agents, suppliers, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from:

11. Indemnification

You agree to indemnify, defend, and hold harmless ShiftSlumber and its officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable legal fees) arising out of or relating to your violation of these Terms or your use of the App.

12. Third-Party Services

The App integrates with third-party services including Apple App Store, Google Play, RevenueCat, Anthropic, and Apple Health / Google Health Connect. Your use of these services is governed by their respective terms and policies. ShiftSlumber is not responsible for the content, privacy practices, or availability of any third-party services.

13. Modifications to the Service

We reserve the right to modify, suspend, or discontinue the App (or any part or content thereof) at any time with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the App.

14. Modifications to These Terms

We may update these Terms from time to time. We will notify you of material changes via in-app notification. Your continued use of the App after any such changes constitutes your acceptance of the new Terms. If you do not agree to the modified Terms, you must stop using the App.

15. Termination

We may terminate or suspend your account and access to the App immediately, without prior notice or liability, for any reason including if you breach these Terms. Upon termination, your right to use the App ceases immediately.

16. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of Queensland, Australia, without regard to its conflict of law provisions.

Any dispute arising from or relating to these Terms or the App shall be subject to the exclusive jurisdiction of the courts of Queensland, Australia.

For disputes, please contact sleepportfolio@gmail.com first — we aim to resolve issues informally within 30 days before either party commences formal proceedings.

17. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices published by us on the App, constitute the entire agreement between you and ShiftSlumber concerning the App.
